Acceptable Use Policy
This Acceptable Use Policy (“AUP”) applies to all use of the Services provided by SPY Genesis Corp. (trading as “SpacePay”). This AUP is incorporated by reference into the API Terms of Service and the Master Service Agreement.
1. General Principles
1.1The Services are designed to provide crypto-to-fiat payment settlement infrastructure for duly licensed and regulated businesses. The Company does not provide services to individuals or unregulated entities.
1.2All Clients must hold the appropriate licence or authorisation in each jurisdiction in which they operate and must provide evidence of such licensing upon request and on an ongoing basis.
2. Permitted Use
2.1The Services may be used exclusively by Clients that hold valid licences issued by recognised regulatory authorities for the conduct of: (a) online gaming and sports betting; (b) licensed payment services; (c) regulated financial services; or (d) other lawful commercial activities approved by the Company in writing.
3. Prohibited Use
3.1The Client shall not, and shall not permit any End User to, use the Services for or in connection with:
(a)unlicensed gambling or gaming activities in any jurisdiction;
(b)activities in jurisdictions where online gambling is prohibited by law, unless the Client holds a specific exemption or licence;
(c)money laundering, terrorist financing, sanctions evasion, or any other financial crime;
(d)the proceeds of, or payments related to, the manufacture, distribution, or sale of illegal drugs or controlled substances;
(e)the sale or distribution of child sexual abuse material or any content that exploits minors;
(f)activities that infringe the intellectual property rights of any third party;
(g)Ponzi schemes, pyramid schemes, multi-level marketing fraud, or any other fraudulent activity;
(h)ransomware payments or facilitating extortion;
(i)circumventing sanctions or export controls imposed by the European Union, United Nations, United States, or United Kingdom;
(j)any activity that is illegal in the jurisdiction of the Client, the End User, or the Company.
4. Jurisdiction Restrictions
4.1The Services shall not be used to process transactions involving End Users located in Prohibited Jurisdictions. The Company maintains and updates a list of Prohibited Jurisdictions, available to Clients upon request and through the API Documentation.
4.2The Client is solely responsible for implementing and maintaining geo-blocking, IP verification, and other controls necessary to prevent transactions from Prohibited Jurisdictions.
5. Monitoring and Enforcement
5.1The Company reserves the right to monitor the use of the Services for compliance with this AUP. The Company may, at its sole discretion and without prior notice: (a) suspend or terminate the Client's access to the Services upon any violation of this AUP; (b) report suspected criminal activity to the relevant authorities; and (c) retain and produce records as required by law.
5.2Violation of this AUP constitutes a material breach of the API Terms of Service and the Master Service Agreement.
